The validity of a loved one's last will and testament can be challenged on several legal grounds and stop the probate process, disclosed Virginia Elder Law Attorney Rory Clark.

Probate is the administration of a person's estate and is finalized by a Probate Court, settling the distribution of assets. However, the process can be stopped and even revoked.

The founder of The Legacy Elder Law Center in Leesburg, VA., elaborated: "To contest or question the validity of a will, a person must have "legal standing. This means anyone who could have a stake in the will. These could include legal heirs, beneficiaries and even creditors."

Legal grounds to contest a will can include:

• an unduly influenced a person to change the will or to draft a new one in their favor;
• the person was mentally incapacitated; therefore, they could not legally sign the will;
• forgery or fraud is suspected in that it was not approved or signed by the deceased;
• the person was unlawfully detained at the time of making the will;
• a mistake invalidated the will;
• the current will has been canceled due to the existence of a more up-to-date one.

Clark emphasized that the process could even be halted because the will's executor lacks the documents necessary to continue a seamless transition. "It is the executor's responsibility to have financial and legal documents relevant to a deceased person's estate.”

"Without them, an executor cannot fulfill their obligations to complete the process, and a probate court cannot oversee the closure of that estate."

A legal contest can be issued before the petition for probate takes place or within 120 days of a scheduled hearing date to accept the will for probate.

Clark said a will contester needs to seek guidance from an attorney specialized in this field. "Even if they wish to press ahead, litigation must be supported by extensive documentation and witness testimony. A challenge will stop the process until the issue is resolved."

He warned that contesting a will can cause extensive and expensive delays until its conclusion. Equally, a probate court's decision can be appealed again, further lengthening the process.

He added: "Delays of months can be experienced and add to the uncertainties surrounding the estate. Someone intending to challenge a will needs to be aware of the risks involved.”

“If they lose, they could be forced to pay the other side's legal bill. Not to mention the hurt, consternation and irreparable damage it could cause to a family dynamic in the future.”
